By downloading, installing, or using the AI Companion mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms form a binding agreement between you and Paul Allen Johnson ("we," "our," or "us").
AI Companion is a mobile application that provides an AI-powered virtual companion experience, including text and voice chat, mood tracking, journaling, and memory features. The AI responses are generated by third-party large language models and do not reflect the views of any real person.
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old. We verify your age at first launch. If we discover that a user is under 18, we will delete their account and data.
To use certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity on your account. Notify us immediately of any unauthorized use.
You may delete your account at any time from within the App (Chat tab → Account menu → Delete Account). Deletion is permanent and irreversible.
AI Companion offers optional paid subscriptions (Plus at $4.99/month and Premium at $9.99/month) that unlock additional features, including higher daily message limits, voice calls, and ad-free experience.
Auto-Renewal: Subscriptions automatically renew for the same term unless canceled at least 24 hours before the end of the current billing period. Your payment method will be charged for renewal at the then-current rate.
Managing Subscriptions: You can manage or cancel your subscription through your Apple ID settings (iOS) or Google Play Store (Android). We do not process payments directly.
Refunds: Refunds are handled by Apple or Google according to their respective store policies. We cannot issue refunds directly.
Deleting your Account Does Not Cancel Your Subscription. You must cancel your subscription separately through the App Store or Google Play before deleting your account to avoid further charges.
The AI companion is a software simulation. It is not a real person, therapist, counselor, medical professional, or substitute for professional advice of any kind. AI responses are generated by third-party language models and may be inaccurate, incomplete, or inappropriate. Do not rely on the AI for:
- Medical, legal, financial, or mental health advice
- Crisis support or emergency situations
- Factual information about real people, places, or events
If you are in crisis or experiencing a mental health emergency, please contact emergency services (911 in the US) or the Suicide & Crisis Lifeline (call or text 988) immediately.
You retain ownership of the messages, journal entries, and other content you create in the App ("User Content"). By using the App, you grant us a limited, non-exclusive license to process your User Content for the sole purpose of providing the App's features (such as AI responses, memory, and sync).
You are responsible for your User Content and must not submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable. We reserve the right to remove content that violates these Terms.
You agree not to:
- Use the App for any illegal purpose or in violation of any laws
- Attempt to reverse-engineer, decompile, or extract source code from the App
- Use automated tools, bots, or scrapers to access the App
- Submit content designed to harm, harass, defame, or deceive others
- Use the App to generate sexually explicit content involving minors, non-consenting adults, or real identifiable people
- Attempt to disable, bypass, or circumvent security features, age verification, or usage limits
- Resell, sublicense, or commercially redistribute access to the App
- Impersonate another person or misrepresent your affiliation with any entity
The App, including all software, graphics, logos, text, and content (excluding User Content), is owned by Paul Allen Johnson and protected by United States copyright law and international treaties. AI Companion is a registered work with the U.S. Copyright Office (Case #1-15122154221).
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
The App uses third-party services, including Anthropic (Claude AI), OpenAI, ElevenLabs, Google AdMob, Expo, and Resend. Your use of the App is also subject to the terms and privacy policies of these services. We are not responsible for the practices of third parties.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY CONTENT GENERATED BY THE AI WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PAUL ALLEN JOHNSON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Paul Allen Johnson from and against any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice, including for violations of these Terms. Upon termination, your right to use the App ends immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.
These Terms are governed by the laws of the United States and the State of [Your State], without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of [Your County/State].
